Terms and Conditions

These terms and conditions relate to all and any agreement between us when you buy services and/or products from us.

Definitions
Client means the person/persons named on the Proposal for whom the Sole Trader has agreed to provide the Services in accordance with these Conditions.
  • Sole Trader means Suzanne Nagel.
  • Services means anything the Sole Trader does on your behalf in accordance with this agreement. 
1. Digital Services
Our products and services are provided to the best of our ability and based on the Designer’s or Developer’s personal experience and any information, facts and issues you provide.

2. Compatibility
The Sole Trader will use our best endeavours to ensure that any blogging websites designed and/or developed is compatible with the published web standards of the provider. The presence of the website on the internet is not our responsibility. The Sole Trader is not responsible for web-hosting and no guarantees can be made as to the availability or interruption of any hosting service. Ultimate responsibility for the client’s computers, including servers, hardware and software, hosting, internet connection, cabling rests with you. 

3. Prices and Payment 
Payment for all services must be made in full, by cash, standing order, cheque or direct deposit.

4. Training
Training for computer and internet is provided on an individual basis in two (2) hour blocks. Training for website maintenance is not included in the development of a website, should a client require training for maintenance an hourly rate will be charged. Based on the website and its structure, maintenance training could take between one and four hours. All training sessions will be provided in two hour blocks to Clients who live in Dubbo NSW. Website maintenance for Client’s outside of this area will be directed to online tutorials without charge. A training session may be rescheduled or terminated, the later without refund, in the event of thunderstorms.

5. Client Obligations
Where the Sole Trader is required to perform the Services on Client premises, the Client agrees to provide a full and safe working environment.

6. Refunds - Web Development
Clients can cancel services by writing to info@suz.services with fourteen (14) days. The Sole Trader will then delete your account. A refund will be issued within seven (7) days of notification less 20% of the cost of the total product. If you reject completed work within the 7-day review period, or not approve subsequent work performed by us to remedy any points recorded as being unsatisfactory, and we, acting reasonably, consider that you have been unreasonable in any rejection of the work, we can elect to treat this contract as at an end. 

7. Data Back-Up & Maintenance
It will always remain your responsibility to retain up-to-date back-ups of any data in connection with your website once the Sole Trader has helped you set up that website. Copyright dates and change of contact details will be updated free for the life of either the website or our Services, whichever ends first. A copy of your completed template will be kept on file at handover.

8. Limitation of Liability 
The Client will not, under any circumstances, seek to hold the Sole Trader responsible or liable for loss, incidental or consequential damage, or loss arising out of installation, use (unauthorised or otherwise), errors, mistakes, accident, theft or fraud, destruction, or any part of the provision of services or any loss or damage whatsoever either under this agreement or in relation to the provision of the services, including but not limited to: (a) loss of profits arising out of, or in connection with, this agreement (b) use, misuse, suspension and or loss of any Client domain registrations (c) processing of an application for domain name registration (d) hosting services applying to any relevant domain name registered to the Client (e) events beyond the control of the Sole Trader. The Sole Trader makes no warranty against electronic virus, worms or any other fault or defect or problems which may occur or to issues relating to the operation of third party software nor the availability of updates and upgrades. You hold us free of all liability and responsibility for any actions or results or adverse situations created as a direct result of specific referral or advice given by us. All advice is provided in good faith. The Sole Trader does not take any responsibility for damages or errors made to the site by the Client or a third party after the website has been completed and handed over.

9. Intellectual Property
The Sole Trader will utilize web content material which may be subject to trademarked or copyright. These items are warranted by the client as having the appropriate approvals and consent from the parties owning that content. Any intellectual property owned by the Sole Trader used in the development of a website or SEO/Internet marketing processes remains the intellectual property of the Sole Trader and may only be reproduced or copied with the consent of the Sole Trader. All documents that the Sole Trader provides to you are subject to our copyright and intellectual property rights. The Sole Trader specifically provides you with the right to use those documents during the training sessions and after the sessions for your own use.

10. Links
Our Websites may contain various links to third-party Websites. These sites may provide additional information, goods, services and/or promotions. These sites are owned and operated independently of the Sole Trader, and have their own separate privacy and data collection practices. Any information you provide to these Websites will be governed under the terms of their privacy policy, if any. The Sole Trader has no responsibility or liability whatsoever for the independent actions or policies of these independent sites, and is not responsible for the content or privacy practices of such sites

11. Homesit Bookings & Cancellations
Bookings are on a first booked (and paid), first served basis. Clients will be asked to pay a small non-refundable deposit ($50) to reserve dates. Services cancelled less than two (2) weeks in advance of start of Service may be transferred to a new booking, less $50 booking fee. This new booking is to be used within 6 months. No refunds will be given. Services cancelled less than 48 hours of start of Service will not be refunded or transferred. A Free Trial is conducted under the supervision of the owner prior to commencement of Service. This ensures that instructions are followed as per request. Service forms, balance of payment and a key (if required) are collected at Free Trial. The Sole Trader will provide daily contact with the Client via MMS after each visit. Photos/videos are copyright to the Sole Trader. Keys are tagged with a Sole Trader code and kept secure between visits. The key will be left at a delegated area on the last day of service. Extra visits to return a key or for an emergency house check will be charged ten (10) dollars. The Client should nominate a second person in the event that something should happen to prevent the Sole Trader from fulfilling their duty of Service. The Client should be alerted by absence of daily communication. In the event of failure to provide Service the Client can expect a full refund of the entire Service block. If no second person has been nominated by the Client the Sole Trader may engage the services of another provider and pay them accordingly. The Sole Trader may end a Service at any time if there are safety concerns arising from animals or humans associated with the Client.

12. Pet Sitter and Pet Safety
It is the discretion of the Sole Trader to take on any dogs with challenging behaviours. The Sole Trader typically performs chores in the early morning with one visit per day. This might not suit those pets who are in an afternoon food routine. The Sole Trader does not typically walk dogs. Regular Clients with multiple dogs (3+) should supply rubber slip-ons (boots). Rubber gloves must be supplied. It is recommended that Client leaves paper towels and/or faded microfibre cloth and mop/bucket if pets are prone to accidents inside the home. Any messes on carpets/rugs are cleaned up with a damp cloth (no cleaners). Pets kept together must be compatible and not have a history of fighting when left alone together. If there is any significant risk to the Sole Trader or any pet or members of the public an attempt will be made to make the immediate situation temporarily safer. This may include confinement in a separate area of the property, handing responsibility over to an emergency contact or boarding one or more pets. Client is responsible for any costs associated with injuries, private boarding or damage to property resulting from a dangerous situation or from attempting to making a dangerous situation safer. The Sole Trader will never invite unregistered or uninsured persons into your home.

13. Jurisdiction
The Sole Trader may update these Terms & Conditions at any time. These Terms & Conditions shall be interpreted, construed and enforced in accordance with Australian law and shall be subject to the exclusive jurisdiction of the Australian Courts.
